Welcome to Custom Duck Company (operated by Duck World). These terms and conditions apply to all orders, quotes, and use of our website at custom-ducks.com. By placing an order or using our website, you agree to these terms.
We've written these in plain English to keep things simple. If anything is unclear, just ask us.
1. Quotes & Orders
When you submit a quote request through our website, it is just that -- a request. Quotes are not binding on either party.
- We'll respond to quote requests via email, typically within 1-2 business days.
- A quote becomes a confirmed order only when both parties agree to the terms in writing (usually via email).
- Quotes are valid for 30 days from the date they are issued, unless otherwise stated.
- We reserve the right to adjust pricing if the project scope changes after a quote has been issued.
2. Minimum Order Quantity
Our minimum order quantity is 500 units per design. This applies to all custom rubber duck orders, regardless of complexity or customization level.
3. Pricing
- All prices are quoted in USD unless otherwise agreed.
- Pricing depends on order quantity, design complexity, customization level, and any special packaging requirements.
- The more units you order, the better the unit price. We're always happy to provide pricing for different quantities so you can compare.
4. Production Timeline
Typical production time is 5-10 weeks from design approval to delivery. This can vary depending on:
- Design complexity and customization level
- Order quantity
- Whether a physical sample is requested
- Shipping destination and method
We'll give you an estimated timeline with your quote. Rush orders may be available -- contact us to discuss.
5. Samples
We can produce a physical sample of your custom duck for approval before committing to a full production run.
- Samples are available for a surcharge, which we'll quote separately.
- Sample production typically adds a few additional weeks to the overall timeline.
- We strongly recommend samples for complex or highly customized designs.
6. Payment Terms
- Payment terms will be outlined in your quote and order confirmation.
- For new customers, we typically require a 50% deposit to begin production, with the remaining 50% due before shipping.
- For returning customers, we may offer alternative payment arrangements.
- We accept bank transfer and other payment methods as agreed.
7. Artwork & Intellectual Property
- You are responsible for providing the artwork, logos, and design references for your custom ducks.
- By submitting artwork, you confirm that you own the rights (or have permission to use) all logos, images, and designs provided.
- We are not liable for any intellectual property disputes arising from artwork you supply.
- Ideally, provide vector files (AI, EPS, SVG) or high-resolution PNG/PDF. Don't worry if you only have a JPEG -- our design team can work with most formats.
8. Design Approval Process
Before we begin production, you'll receive a digital proof or mockup of your custom duck design for approval.
- Production will not begin until you've approved the design in writing (email is fine).
- Once you approve a design, you accept responsibility for the accuracy of colors, logos, text, and overall design.
- If you request changes after approval and production has started, additional charges and delays may apply.
9. Shipping & Delivery
- We ship worldwide via air, sea, and road freight.
- Shipping costs are quoted separately and depend on order size, weight, and destination.
- The buyer is responsible for all import duties, taxes, and customs fees in their destination country.
- We'll provide tracking information once your order has shipped.
- Delivery times vary by shipping method and destination. We'll provide estimated delivery dates with your shipping quote.
10. Returns & Refunds
Because our products are custom-made to your specifications, we are unable to accept returns or offer refunds on completed orders, except in the following cases:
- Manufacturing defects -- if the product does not match the approved design due to a manufacturing error, we'll work with you to resolve the issue. This may include reprinting, replacing, or refunding affected units.
- Shipping damage -- if products arrive damaged due to shipping, please notify us within 7 days of delivery with photos and we'll arrange a resolution.
We are unable to offer refunds for orders that match the approved design but are no longer wanted or needed.
11. Liability
- Our liability is limited to the value of the order in question.
- We are not responsible for delays caused by events outside our control (shipping delays, customs holds, natural disasters, etc.).
- We are not liable for any indirect, consequential, or incidental damages arising from the use of our products or services.
- While we do our best to match colors precisely (including Pantone matching), slight variations may occur between digital proofs, physical samples, and final production runs due to the nature of manufacturing.
12. Cancellations
- Orders may be cancelled before production begins, subject to a cancellation fee if materials have already been sourced.
- Once production has started, orders cannot be cancelled.
- If you need to cancel, please contact us as soon as possible so we can discuss your options.
13. Governing Law
These terms are governed by and interpreted in accordance with applicable laws. Any disputes will be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the courts in the country where Custom Duck Company is registered.
14. Changes to These Terms
We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Changes will not apply retroactively to orders already confirmed.
